Judge Ernesto Romero participates in ex parte communication prior to a hearing, throws mother in prison based on hearsay during hearing for Motion to Compel Discovery, and leaves children with no one to pick them up from caretaker.
It was simply a hearing for a Motion to Compel. A new Guardian ad Litem (GAL) had been assigned to the case about a month prior to the hearing. An hour prior to the hearing, at 2:00 p.m., Judge Ernesto Romero met privately with the GAL, James Owens in his chambers download log showing Owens' appearance an hour before the hearing as pdf and during that meeting called a law enforcement officer to attend the hearing. Note from page 2 of the sheriff's log (circled item) the time of 2:10 pm, shortly after the GAL arrived in Judge Romero's chambers and much earlier than the hearing which started at 3:00 p.m. In the middle of the hearing, the Guardian stated that the mother had been talking to the children about the case. He cited no evidence and provided no particulars. This issue was not before the Court via a prior Motion. The mother, under oath, emphatically denied this accusation. Based on the GAL's hearsay alone, Judge Romero sentenced the mother to jail. Download hearing transcript as pdf She was told to remove her jewelry, handcuffed, and hauled off to the Bernalillo County West Side Detention center and locked up for a number of hours. When sentenced, this mother, a professional woman who was dressed in a pink suit and heels for the hearing in court, apparently went into shock and fainted. She was put into a chair for a brief period of time and then hauled off to jail. No medical attention was provided. Her two elementary-school-aged children were supposed to be picked up from their caretaker shortly after the hearing. Because of her condition, she could not properly communicate to CFJ supporters present at her hearing where and how to contact the caretaker to pick up the children. They remained at the caretaker's home for hours after the hearing, causing distress and alarm for the mother, children, and caretaker alike. Judge Romero wrote an official order from the hearing, but after the mother contacted the media regarding this story and they called the judge for information, he subsequently modified and reissued his order without proper documentation
