Judge Ernesto Romero decided eight issues without notice of the issues to the litigants and without any hearings. This is a violation of federal due process rights.
Download the resulting Order as pdf He made these decisions shortly after the mother, also President of CFJ, filed a Motion to Recuse and before he actually recused from the case. Among other things, Judge Romero refused to acknowledge evidence of a real estate conflict of interest between the opposing attorney, Sandra Morgan Little and the Guardian ad Litem, or attorney for the child. He states in his order that mother and her attorney should have been diligent enough to notice the real estate conflict earlier in the case. But the law says under the Rules of Professional Regulation (New Mexico Statutes Chapter 16) that the attorneys are responsible for self-reporting such conflicts. Mother happened to notice the real estate information in the county records because of her research for CFJ. Judge Romero also orders mother to take her $9000 college fund that she alone saved for their child and move it to a bank in Norman, Oklahoma, allowing it to come under father's control. A bank account is a terrible investment plan for a fund that will not be used for eight more years. The child lives here in Albuquerque, not in Oklahoma. In this manner, Judge Ernesto Romero and other judges like him are responsible for the bleeding of a family and their life savings, to the tune at times of hundreds of thousands of dollars in a few short years. Do you think the courts should be able to take control of your life-long savings fund for your child or children, tell you how and where to invest it, and give control to others? This is what one would expect from a communist or socialist country, but not from the democratic superpower of the world. Finally, Judge Romero directly defies the Constitution of the United States in section X of his order which states, "the Clerk of the District Court is hereby ordered not to permit any party in this litigation to file any further "responses" to this Court's orders." The Rules of Civil Procedure allow for such filing. Essentially, he is stifling mother's ability to object on the record to bias as evidenced by th judge's failure to follow the rules of civil procedure and his making of slanderous statements in his orders that can be proven to be false from other information in the docket file. According to the Second Judicial District Court Clerk's office, they have been given orders not to allow mother to file anything without the judge's written permission. Mother attempted to file a Notice of Nonavailability and was prevented from doing so without the judge's permission. On January 20, 2005, Mother attempted to file a Notice of Appeal regarding this order. Once again she was prevented from doing so without the judge's permission. This is a direct violation of the First Amendment right to petition the court. Judge RomeroJudge Romero has no respect for the Constitution of the United States and the rights it affords citizens. In his courtroom, litigants are regularly denied such rights. Such a judge should be removed from the bench. Judge Romero's actions, along with the complete failure of the New Mexico Supreme Court and Judicial Standards board to act on numerous complaints about his behavior, are exactly the reasons why we've gone down that slippery slope such that our country's citizens have less rights with respect to their own homes and families than the citizens of most other countries in the world. What kind of "freedom" is that? Something is broken when this kind of lawlessness is allowed to run rampant on the part of a mere man who dons the robe. The robe is sacred to our democracy, but the man is not. Remove the man or the public will scoff and laugh at the robe as a joke.
