New Evidence: Rick Hermann Was Unlawfully Detained new

On January 9, 2008, Rick Hermann left his Rio Rancho, NM home (in Sandoval County) just after 11:00 a.m. to head to Bernalillo County to work. He stopped at the Arby's on Paseo del Norte (near the intersection with Jefferson Blvd.) for lunch. Three unmarked Bernalillo County Sheriff's Department (BCSD) cars pulled into the Arby's parking lot, officers emerged, and approached Rick at gunpoint.

Rick was handcuffed, with cuffs behind his back, and placed in the back seat of one of the vehicles. It had only been a couple months since Rick had major back surgery in Germany. It was very painful. After being placed in the BCSD vehicle, Rick waited. And waited. And waited. In fact, it was more than three hours from the time Rick was arrested until the time they left the Arby's parking lot. During that time, the deputies bought Rick some food and talked with him. According to Rick, he was never Mirandized (read his rights).

Why the waiting game? Rick states that he was arrested at about 11:30 a.m. on January 9, 2008. A receipt from towing Rick's vehicle shows that it was towed away at 12:15 p.m. that day, with the reason for towing being "driver arrested". We later learned the purpose for the waiting game. The warrant for Rick's arrest was not filed in Bernalillo County Metro Court until 3:26 p.m. In other words, BCSD officers unlawfully detained Rick for about four hours prior to obtaining an arrest warrant.

Rick was arrested on a misdemeanor state charge of "harassment". Deputy John Kenna arrested him and provided an affidavit for the criminal complaint filed in Bernalillo County Metro Court on January 9, 2008 at 3:26 p.m. The complaint states that James Noel, Executive Director and General Counsel of the New Mexico Standards [Commission], forwarded the threatening email to Judge Nan Nash. The complaint also states the James Noel co-teaches with Nash at UNM.

Interestingly, District Court Judge Stan Whitaker signed both the complaint and the arrest warrant. Was there no judge in Metro Court willing to get involved? Is it legal for a judge in a completely different courthouse to sign a Metro case complaint and warrant?

Even more interestingly, Judge Whitaker showed up for two hearings in Rick's federal case. The detention hearing occurred on Friday, January 11 in Federal District Court. Judge Whitaker was sitting in the back of the room. In other words, we the taxpayers paid Judge Whitaker to spectate at a hearing that had nothing to do with him. He chose to spectate instead of doing his job - hearing cases in Bernalillo County District Criminal Court.

On top of that, Judge Whitaker showed up again at Rick's appeal of detention hearing on Friday, January 18 in Federal District Court. This time, Whitaker gawked from the back along with Judge Nan Nash and Judge Linda Vanzi. (We called them the "crooked judge brigade" when they showed up.) That Friday morning, the taxpayers of New Mexico paid all three judges while they cancelled hearings in order to hang out and spectate at Rick's expense. As you will see below, the second hearing ended up being much more than simply an appeal of detention. Judge Black attempted to commit Rick to a mental facility for sixty days of evaluation. We believe that the crooked judges sitting in the peanut gallery at taxpayer expense knew ahead of time what was to occur. Incidentally, Nash must not have been very frightened of Rick if she felt the need to show up and enjoy his hearing.

Why is Whitaker so invested in this case that he would sign documents for a different court and then show up on two different days while taxpayers pay him to sit on his butt and spectate? Good question. The public should demand an inquiry of him and a public answer to this question. Rick's case never should have been elevated to the federal level, since any information gleaned from him to elevate the charges occurred during unlawful detention and without the legally-required reading of Miranda rights. The emails alone do not justify the federal case. The items found in Rick's car should no longer be allowed as evidence since they were unlawfully obtained. Rick has been in a federal jail cell for nearly eight weeks now under false pretenses, and he lost his software engineering job of 24 years, including benefits and retirement, because of these jokers. Looks like a major lawsuit against BCSD to me. We'll see what the feds do about it.

Rick Hermann a long-time member of CFJ, is a sharp, energetic and warm individual who regularly interacts with our group. He is quite the communicator and quite the investigator, drawing upon his professional skills as a software engineer with 24 years of experience at a major U.S. corporation government contractor to support many of CFJ's objectives. Most recently those objectives have included a big push to collect and expose evidence of the anti-American nationalist coalition operating the "legal" child trafficking network in New Mexico.
  • Rick's efforts from his letter writing and email writing campaigns to a variety of New Mexico officials have been very effective because he combines his requests with factual information that is not always easy to find. The judiciary and supporting system do not want the public to learn what Rick has discovered. For example, he drafted a letter to NM Attorney General Gary King, mailed in 2007, exposing the failure of the Judicial Standards Commission to carry out its charge of investigating reported complaints about NM judges. Rick is very factual and logically drills down to obvious conclusions. Note that Rick makes it clear that he does this for all New Mexicans so that we can have more open government and stop the concealment by our government of complaints about judges and the near total lack of response on the part of the Judicial Standards Commission.
  • However, Judicial Standards Commission Director Jim Noel begins the attack on Rick in his response letter, by claiming Rick is "upset" when there is no reason to think Rick is doing anything but trying to improve New Mexico for all citizens (except, of course, corrupt judges and the governmental system that protects them at all costs). The tone of Jim Noel's letter, very defensive and accusatory, imputing emotions to Rick that are not evident, is clearly a lead in to the ultimate punishment leveled at him for knowing too much and expecting democracy (remember way back when - "a government by the people, for the people . . . .") in New Mexico - an unjust accusation followed by a federal jail cell with no bail.
  • In Jim Noel's follow up letter to NM AG Gary King, he remains defensive and hides behind the NM Constitution (Article VI Section 32), which states that complaints and deliberations by the Judicial Standards Commission remain sealed from the public forever, unless the commission decides to take action against a judge. In other words, hundreds of complaints may pour in to the commission about certain corrupt judges (and our evidence shows that they do), and Jim Noel's ragtag outfit can send the same, ridiculous response to every complainant - that "insufficient evidence" exists to do anything. Jim clearly wants to keep it that way. He fails to note that judges and their cronies pushed for the Constitutional clause anyway, or that many states in our country no longer tolerate such fascist secrecy when it comes to the activities of those who wear the black robes and pass judgment on every aspect of citizens' lives from how they talk to their children to how they run their companies.
  • Rick's recent efforts over the last few weeks have gleaned extremely valuable and incriminating information about the "judicial" coalition and its operations. Rick always communicates online through the same msn.com email account and has done so for years. He uses this account to communicate with both CFJ and the variety of government officials he has contacted.
  • Incriminating information he recently discovered includes the following:
    • MALDEF's most recent election of officers to its Board of Directors includes former NM Attorney General Patricia Madrid. Affectionately dubbed by CFJ as the "fairy godmother" of the judges since she repeatedly stated throughout her term of office that her role was to protect the judges from accusations rather than investigate them. She remained true to that statement during her tenure.
    • A NM legal case reveals that Governor Bill Richardson illegally replaced over half of the members of the Judicial Standards Commission, a NM board that is charged with the duty of investigating judicial wrong-doing and corruption and with recommending to the NM Supreme Court cases to be tried for disciplinary action. By conducting this act, Governor Richardson was able to greatly influence the kinds of conclusions arrived at by the group.
    • An additional great find by Rick was that retired NM Supreme Court Judge and founding MALDEF member Dan Sosa, Jr. was appointed to one of the seats required to be filled by a "non-attorney" on the commission. This discovery exposed a very strong link between Governor Richardson and many of the other nefarious activities described on this site regarding the MALDEF-led coalition. The discovery occurred while Governor Richardson was actively campaigning for President of the United States.
    • Rick was actively making critical links between CFJ efforts and those of like-minded New Mexico attorneys and a national network of persons who oppose the goals and activities of MALDEF and its impacts on the United States
  • Rick filed a complaint with the Judicial Standards Commission regarding the arbitrary way in which Judge Nan Nash ignored a Florida court's order ratifying he and his ex wife's prenuptial agreement costing Rick thousand and thousands of dollars. His expenses were not limited to those of his attorney and those dictated by Judge Nash's failure to recognize the valid court order. Rick was also held responsible for paying his ex-wife's attorneys fees based on Judge Nash's decision.
  • All of these decisions were ratified by a final decree issued in mid-2006. Rick was encouraged by other CFJ members to appeal based on the glaring failures of Judge Nash in the district court case. However, Rick knew going into the appeals that he was not likely to win since a myriad of CFJ members shared with him the results of their appeals exhibiting the flippant way in which the NM higher courts handle the law.
  • Rick's appeals did not meet with success and he had decided to let the issue go. He underwent some major surgery and was contacted by CFJ President, Leslie Cumiford in the fall of 2007 and asked if he would help with some much needed behind the scenes research. Rick took on the project with gusto and was very excited to see how much progress had been made earlier in 2007 while he was relatively inactive with the group. He cheerfully applied his skills resulting in the very valuable evidence described above.
  • On Monday, January 7, 2008, the CFJ received a bizarre email from the email account "rb_nm@hotmail.com". CFJ President Leslie Cumiford in her cursory review of recent CFJ emails noted the first paragraph of the email on Tuesday, January 8, 2008, and noted the fact the email was not from the email address Rick always used over the years to correspond with CFJ as well as government officials. rb_nm@hotmail.com is the very same email that has allegedly been linked to the press and widely quoted in federal criminal court documents.
  • CFJ members first learned of Bernalillo County Sheriff Department arrest of Rick Hermann through an article that appeared on Thursday, January 10, 2008 in the Albuquerque Journal. CFJ members are shocked by the allegations of law enforcement, the lack of evidence supporting their claims and the way in which Rick has been personally treated while incarcerated. The contents of the email coming from an account Rick has never used and containing content that is frankly ridiculous and uncharacteristic of Rick's style as evidenced in recent letters and by his frame of mind during the entire time we have interacted with him.
  • There is a very clear pattern over the last several years of false reports of threats against the most corrupt of the Bernalillo District Court judges. This particular case has not yet played out to its conclusion, but we have posted convincing evidence that judges have been responsible for such false claims in the past.
  • It should be noted that Judge Nan Nash has also been under the tutelage of Anne Kass.
